The Protection of Women from Domestic Violence Act, 2005, enacted on 13, September, 2005, stands as a significant milestone in India’s pursuit of gender justice. Recognizing domestic violence in all its forms of physical, emotional, sexual, economic, and verbal. The Act empowers women in relationships of various kinds, including marriage, cohabitation, and relationships with family members. It provides a critical safety net by establishing a system of Protection Officers who assist women in filing complaints, accessing legal aid, and securing medical care. Importantly, the Act recognizes a woman’s right to reside in the shared household irrespective of ownership, ensuring she has a safe space. Orders can be obtained for protection, residence, custody of children, compensation, and even maintenance. The Act also mandates counselling for both parties, promoting a potential path to reconciliation or a dignified separation. By equipping women with legal recourse and a support system, the Act challenges the historical gender imbalance within households, promoting a society where women are free from violence and have the power to determine their destinies.

The extends to whole of India except Jammu and Kashmir. The Act consists of 37 sections.
