The Surrogacy (Regulation) Act, 2021 aims to eliminate the commercialisation and trade of human embryos, gametes, and surrogate services across India while permitting altruistic surrogacy to protect surrogate mothers and children from exploitation. Its core objectives include restricting surrogacy to legally married Indian couples with a medical indication for gestational surrogacy. The Act is ensuring surrogate children possess full biological rights and cannot be abandoned for any reason, and safeguarding surrogate mothers through written informed consent and mandatory 36-month health insurance coverage. Furthermore, the Act regulates clinical practices by establishing National and State Assisted Reproductive Technology and Surrogacy Boards, appointing regulatory authorities to oversee clinic registration, and enforcing strict prohibitions against sex selection, commercial advertising, forced abortions, and unauthorized embryo storage.
The Act consists of 54 sections in 8 chapters.
