A landmark judgment in the realm of maintenance and Triple Talaq in India. It is the crowning glory in the path of achieving the rights and freedom of Muslim women. The apex court has departed from the traditional notion of Muslim personal Law so as to endow gender justice to the Muslim women in the matter of maintenance. Denial of maintenance to women who are unable to maintain themselves itself is a discriminatory provision in a secular state. The case pinned down the balance drawn by the higher judiciary between the provisions of civil law and the Muslim personal law. As a response to this case, Muslim women (Protection of Rights of Divorce) Act, 1986 was enacted to protect the rights of the divorced Muslim women.
