The Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, 1994

The Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, 1994 was enacted on 20, September 1994. It aims to prevent the harmful practice of female feticide in India. Section 3B prohibits sex selection before or after conception, including the sale of ultrasound machines to unregistered entities. Also, Section 4 regulates pre-natal diagnostic techniques (PNDTs) like ultrasounds, allowing them only for specified medical purposes like detecting genetic abnormalities. Section 5 mandates written consent from the pregnant woman and prohibits revealing the baby’s sex. Section 6 criminalizes sex determination itself. The Act establishes a Central Supervisory Board and State Supervisory Boards to monitor implementation and investigate violations. The Acts sets up Stringent penalties, including imprisonment and cancellation of registrations, aim to deter offenders. By regulating PNDTs and criminalizing sex determination, it seeks to create a legal framework that protects girls’ right to life and fosters a more equitable gender balance.
